General terms and conditions
These rules set the terms and conditions for using the online shop www.posestvo-berce.si/shop/ (hereinafter referred to as “online shop”) managed by Posestvo Berce, Proizvodnja vina in grozdja, Matjaž Berce, s.p., Draga 20a, 5294 Dornberk (hereinafter referred to as “provider”).

The general terms and conditions of the website have been drawn up pursuant to the Consumer Protection Act and other applicable laws on online sales and such commerce.
An online shop is a service supporting the purchase of products of Berce Estate through an online portal www.posestvo-berce.si – BERCE ESTATE shop www.posestvo-berce.si/shop//. It is possible to make a purchase in the online shop without registration and logging in to the shop.
A user is any natural person or legal entity that uses the online shop.
A customer is a person who orders products via the online shop.
Products in the POSESTVO BERCE online shop can only be ordered for the territory of the Republic of Slovenia. Orders can only be placed in Slovenian.
Posestvo Berce, Matjaž Berce, s.p. reserves the right to change the terms and conditions on the website www.posestvo-berce.si/shop/ at any time and without prior notice. Users and customers will be notified of any changes to www.posestvo-berce.si/shop/.
The company reserves the right to correct errors on www.posestvo-berce.si/shop/ of which customers will be notified in suitable time.
Availability of information
The provider will present customers with the following information at any time:
• the identity of the company (name and head office of the company, registration number);
• contact information to support swift and effective communication for users (e-mail, phone);
• product availability (each product or service provided on the website will be available in reasonable time; if not, you will be notified);
• the terms and conditions of the delivery or products and services (the manner, place, and time of delivery);
• all prices must be clearly and unambiguously stated, and must show whether they include taxed and transport costs);
• payment and delivery methods;
• the validity of products and services on offer;
• the deadline within which you can terminate the contract, and the terms and conditions of termination; if and how much a customer must pay if they want to return a product;
• an explanation of the complaint procedure, including all information on the contact person or customer service.
The products and services in the online shop can change in certain cases due to the nature of our operations. All prices are final, unless explicitly stated otherwise. Despite exceptional efforts to provide the most up-to-date and exact information, the information on price may be false. In this case or if the price of a product changes during the processing of an order, the customer will be able to terminate the purchase, and the provider will find a solution to mutual satisfaction.
The pictures of the products in the online shop enakupi.com are symbolic.
A placed order constitutes a purchase contract concluded at the moment when the company POSESTVO BERCE, Matjaž Berce, s.p. confirms the order.
POSESTVO BERCE, Matjaž Berce, s.p. confirms the order by sending a receipt in electronic form to the customer immediately after receiving the order to the e-mail address stated by the customer in the order.
A purchase contract (order) is saved in electronic form on the server of the company POSESTVO BERCE, Matjaž Berce, s.p. and is treated as strictly confidential. A written copy of the order is sent to the customer together with the ordered products.
Orders can be placed online every day between 0.00 and 24.00.
Orders received between Monday and noon Friday will be shipped the same day if in stock. The shipment will be delivered within four (4) days (the day of the order + 4 days).
Orders received on Saturdays, Sundays or national holidays will be shipped on the next business day.
4. HOW TO PLACE AN ORDER
It is possible to make a purchase in the online shop without registration and logging in to the shop.
The customer chooses the product they wish to order. They choose the desired quantity of each product. By clicking “Add to Cart”, they will add the product to the cart. If they place the cursor on the cart in the right upper corner of the online shop, a window opens up that gives two options: “View Cart” and “Continue to Payment”.
By clicking “View Cart”, the customer is transferred to the content of the cart to check their selection and correct it if necessary. When in the cart, they can add, change the quantity, and remove certain products. To confirm changes, click “Update Cart”. You can also continue shopping.
By clicking “Proceed to Checkout”, the customer confirms their selection of products and proceeds to the second step of the purchase, the entry of information and the selection of the payment method. “Order Details” will open up with a form for information on the payer, delivery address, and the payment method. Check your order under “Your Order” and place it by clicking “Buy Now”.
The cart also contains the option to calculate shipping costs. In the cart, you can also use a discount coupon obtained during a website promotion or use company gift voucher if the option to use it in online shopping is stated. Only one coupon or voucher can be used for each purchase. Coupons and vouchers cannot be combined.
When the order is placed, a window with order information and a confirmation of the accepted order opens up.
The customer will receive a receipt of a successfully placed order sent to the stated e-mail address.
5. HOW TO CANCEL AN ORDER
After placing an order, the customer will receive a receipt sent to their e-mail address. A customer can cancel an order within one (1) hour after receiving the receipt of the order by sending a message to the provider’s e-mail address at email@example.com or calling +386 31 886 277 (each workday 8.00–12.00 and 15.00–17.00). If the customer does not cancel their order in this time, this means that a contract on the purchase of products between the customer and the provider (POSESTVO BERCE, Matjaž Berce, s.p.) is concluded.
The provider provides customer support each workday between 8.00 and 17.00 on +386 31 886 277 or firstname.lastname@example.org .
If POSESTVO BERCE, Matjaž Berce, s.p. establishes that an order cannot be carried out under the stated terms and conditions, the company reserves the right to reject the order.
6. PAYMENT METHOD
The payment method is selected by clicking one of the options provided.
The supported payment methods are as follows:
• cash on delivery
• proforma invoice
Direct bank transfer (on a proforma invoice)
A customer will receive the payment information (the amount to be paid, bank account number, reference number, and the purpose of payment) to their e-mail address. In this case, the customer pays for the ordered products using the general order for payment UPN (form) at a bank or post office, or through online banking (Klik, Bank@Net, Abanet, Banka IN, Link, Addiko EBank, etc.).
The amount for a direct bank transfer must be paid within two (2) days, otherwise it is cancelled.
Cash on delivery
In this case, the cost of the ordered products is paid to the delivery person when the parcel is collected. (NOTICE: During the epidemic, the option of cash on delivery is not available.)
Upon confirming your order, select payment via PayPal and you will be redirected to the PayPal page. As you are redirected, all information for the payment of the ordered products will be transferred. Log in to your PayPal account and confirm payment. You will receive the payment receipt sent to your e-mail address from PayPal and us.
7. INVOICE ISSUE
POSESTVO BERCE, Matjaž Berce, s.p. attaches an invoice to the ordered products. The invoice includes the price and all purchase-related costs. The customer must check the accuracy of the information on the invoice.
An invoice contains the following information:
• the information that the seller is POSESTVO BERCE, Matjaž Berce, s.p.;
• information on the customer: name, surname, and address;
• information on the ordered products (name, characteristics, quantity);
• the price of products including taxes and other charges and discounts;
• the purchase price if cash on delivery was selected;
• potential cost of delivery;
• delivery address (if it differs from the customer’s address);
• more detailed payment information.
Prices are the same for all users of the online shop. All prices are in EUR and include VAT, unless explicitly stated otherwise.
The prices are valid when the order is placed and have no predefined validity. The prices are valid for said payment methods and under the terms and conditions stated above.
Despite exceptional efforts to provide the most up-to-date and exact information, the information on prices may be incorrect. In this case or if the price of a product changes during the processing of an order, the provider will allow the customer to terminate the purchase and will find a solution to their mutual satisfaction.
Discounts on individual products and the promotional code cannot be combined.
The ordered products will be delivered to any address in Slovenia. Delivery is carried out by a contracting partner of POSESTVO BERCE, Matjaž Berce, s.p. The delivery time for products in stock is one (1) to four (4) business days. If a product in not in stock, users are notified of that prior to completing the purchase. They are also notified of the anticipated delivery time.
All orders are shipped the same or next business day (if products are in stock). There are no shipments on Saturdays, Sundays and holidays. If you have any special requests, please send an e-mail to email@example.com, call us on +386 31 886 277 or leave a comment on the purchase form. Products are delivered to the address stated in the order.
10. PURCHASE RETURN
Customers can return the purchased products within 14 days of receipt without having to state the reason. Customers can also inform us in writing that they want to cancel the order without having to state the reason for their decision. In this case, the products must be returned to us unused, unopened and undamaged in their original packaging within 14 days. The purchase price for the returned products will be returned to the customer’s bank account within 14 days. The potential costs of return are covered by the customer.
Customers can notify us of the termination of a purchase at firstname.lastname@example.org or by calling +386 31 886 277 (each workday 8.00–12.00 and 15.00–17.00).
If POSESTVO BERCE, Matjaž Berce, s.p. has reason to suspect that a customer has intentionally purchased and then terminated the purchase only to mislead or harm POSESTVO BERCE, Matjaž Berce, s.p., they are not eligible for the return of the amount paid.
If a parcel is damaged, does not contain all ordered products or shows signs of having been opened, the customer must initiate the complaint procedure with the delivery person. We will resolve the complaint in the shortest time possible.
If the products are not what the seller explicitly promised, if the seller has sent the wrong products or the wrong quantity or if the products deviate from the customer’s order in any way, the customer can file a complaint. The products can be returned by prior agreement via email@example.com or +386 31 886 277 (each workday 8.00–12.00 and 15.00–17.00) by mail or personally at Draga 20a, 5294 Dornberk, Slovenia.
Pursuant to the Consumer Protection Act, a defect is material if:
• the item does not have the characteristics necessary for its regular use or placing in circulation;
• the item does not have the characteristics necessary for the special use for which the buyer bought it, and this was or should have been known to the seller;
• the item does not have the characteristics and features that were expressly or tacitly agreed upon or prescribed;
• the seller delivered an item that does not match the sample or model, unless the sample or model was only shown for information purposes.
POSESTVO BERCE, Matjaž Berce, s.p. and its online shop operator Epacka spletni marketing, Gregor Benigar s.p. use suitable technological and organisational means to protect the transfer and storage of personal data and payments.
Personal data protection
With a purchase, a customer allows the company POSESTVO BERCE, Matjaž Berce, s.p. to collect, process, and store the submitted personal data pursuant to the Personal Data Protection Act. POSESTVO BERCE, Matjaž Berce, s.p. undertakes to protect users’ personal data with due diligence and in accordance with the legislation. Data are collected on the basis of the individual’s personal consent for an indefinite period or, if the Personal Data Protection Act stipulates otherwise, for the period foreseen by this act.
Personal data are collected for the smooth fulfilment of orders, communication with customers, statistical analysis to improve the operation of websites and services, and, if a customer decided, sending notifications, news and offers (e-mail, in writing). Users must also protect personal data by installing suitable anti-virus protection on their computer.

www.posestvo-berce.si/shop/ operates as a catalogue sale of products and services. Despite efforts to keep products and services accurate and up-to-date, the information on products and services might change so rapidly that we do not have time to correct it and remains unchanged on the website. If you order such a product or service, the company will notify you of any changes and cancel the order or enable you to cancel the order or agree on another option.
We reserve the right to correct typographical errors and errors arising from unintentional incorrect operation of the website’s IT system. The company is not responsible for the accuracy of information entered by customers.
13. COMPLAINTS AND DISPUTES
The company POSESTVO BERCE, Matjaž Berce, s.p. respects the applicable legislation on consumer protection. The provider must confirm in five (5) business days that it has received a complaint and notify the customer of the procedure. POSESTVO BERCE, Matjaž Berce, s.p. puts in all efforts to meet its obligation to ensure an efficient complaint handling system.
In case of problems, a customer can contact the provider POSESTVO BERCE, Matjaž Berce, s.p. by e-mail. A complaint is sent to the e-mail address or in writing to the head office of the company. The complaint handling procedure is confidential.
Out-of-court settlement of consumer disputes
In accordance with statutory norms, POSESTVO BERCE, Matjaž Berce, s.p. does not acknowledge any provider of out-of-court settlements of consumer disputes as competent to settle consumer disputes that may be instigated by consumers pursuant to the Out-of-Court Settlement of Consumer Disputes Act.
